Eligibility Requirements

To be eligible for the New Zealand Citizen Family Relationship visa (subclass 461), you must meet the following requirements:

• Not be a New Zealand citizen at the time of application
• Meet certain eligibility criteria
• Not be an Australian citizen
• Hold a substantive temporary visa if you are in Australia when you apply, except for a Temporary Work (International Relations) visa (subclass 403) in the Domestic Worker (Diplomatic or Consular) stream

Additional Requirements

In addition to the eligibility requirements, you must also satisfy the following requirements:

• You are not a New Zealand citizen
• You cannot be granted this visa if you are an Australian citizen
• You cannot be granted this visa if you have a No Further Stay condition
• You and any members of your family unit who apply for the visa with you must meet certain health and character requirements
• You should not have any outstanding debts to the Australian Government
• You might not be able to apply for or be granted this visa if you remain in Australia since having been refused the grant of or having had your previous visa cancelled
• We might not grant this visa if it is not in your best interest (if you are under 18 years of age)
